Terms of Service

These Terms of Service apply to residential on-site consultation services provided by Prairie River Engineering & Inspection, LLC. By booking an appointment, you agree to these Terms.

1. Our Service

Prairie River Engineering & Inspection provides residential On-Site Consultations focused on answering questions about the condition and performance of a house.

During a consultation, we may:

  • Discuss your concerns and relevant history
  • Assess visible and accessible areas
  • Assess foundation and structural condition and performance
  • Evaluate a specific item or concern you have questions about
  • Review relevant documents and contractor recommendations
  • Explain what we observe and discuss your options
  • Provide a verbal or written professional opinion

Our professional opinion is based on the conditions, documents, and other information reasonably available at the time of the consultation. New information discovered later may affect or change that opinion.

2. What Is Not Included

Unless separately agreed in writing, an On-Site Consultation does not include:

  • Destructive testing or opening walls and finishes
  • Soil investigations
  • Code-compliance review; our focus is condition and performance
  • Litigation support, expert-witness services, or testimony
  • Engineering design services

3. Visible and Accessible Conditions

Our assessment is limited to conditions that are visible and reasonably accessible at the time of the consultation.

The consultation is a snapshot in time. It is not a warranty, guarantee, or prediction of future movement, leakage, deterioration, or performance.

We may decline to enter or assess areas that are unsafe, inaccessible, or unsuitable for normal access.

4. Your Responsibilities

You agree to:

  • Provide accurate information about the property and your concerns
  • Have authority or permission for us to enter and assess the property
  • Provide safe and reasonable access to areas you want evaluated
  • Tell us about known hazards, access limitations, or unusual site conditions
  • Make relevant documents available at the time of the consultation if you want us to consider them

Relevant documents may include home inspection reports, contractor proposals, lender requirements, appraisals, prior engineering reports, photographs, or similar information.

Documents provided after the consultation may require additional review time and an additional fee.

We may reasonably rely on information provided by you, the property owner, occupants, agents, contractors, or other available parties.

5. Booking, Cancellation, and Rescheduling

Booking an appointment does not guarantee that Prairie River Engineering & Inspection will accept the project.

We may decline, cancel, or reschedule an appointment if:

  • The project falls outside our area of professional knowledge or appropriate scope of practice
  • The property cannot be safely or reasonably assessed
  • Access is unavailable
  • Weather or other circumstances make the consultation impractical

If we decline an engagement, any prepaid amount for services not performed will be refunded.

If you cancel with less than 24 hours' notice or are not available at the property for the scheduled appointment, you may be charged up to 50% of the applicable service fee.

We may also stop or suspend a consultation if unsafe conditions, aggressive behavior, interference, or lack of reasonable cooperation prevents us from completing the work. Fees may still apply for reserved time and work already performed.

6. Fees and Payment

A standard On-Site Consultation with a verbal professional opinion is $300, payable at the time of the visit.

If you choose a written report, the total standard fee is $600. Written reports are released after full payment is received.

Additional fees may apply for travel, unusually difficult access, extended site time, additional document review, return visits, follow-up consultations, or work outside the standard scope. We will disclose additional fees before performing the additional work.

7. Verbal and Written Opinions

Verbal opinions are intended primarily for the client who engaged Prairie River Engineering & Inspection.

Verbal consultations may not be audio- or video-recorded unless we agree in person or in writing.

Written reports are prepared for the specific property, concerns, and purpose for which we were engaged. You may share a written report with relevant third parties, including buyers, sellers, lenders, contractors, or insurers.

Sharing a report does not create a professional relationship between Prairie River Engineering & Inspection and the recipient. A third party may not rely on the report as though they were our client unless we agree to that reliance in writing.

Reports should not be reused for unrelated properties, projects, or purposes.

A written report may contain project-specific assumptions, limitations, or recommendations. If those statements differ from these general Terms, the project-specific statements in the report control.

8. Concerns About Our Service

If you discover a concern related to our consultation or written report, please notify us in writing at questions@prairieriverengineering.com as soon as reasonably possible, preferably within 30 days after discovering the concern.

Please give Prairie River Engineering & Inspection a reasonable opportunity to review and respond to the issue before arranging corrective work or pursuing other remedies when practical.

9. Limitation of Liability

To the fullest extent permitted by Kansas law, Prairie River Engineering & Inspection's total liability for a claim arising from a specific On-Site Consultation or report is limited to the amount you paid for that service.

To the fullest extent permitted by law, we are not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits or diminished property value.

Nothing in these Terms limits liability that cannot legally be limited.

10. Privacy

Our collection and use of personal information is described in our Privacy Policy available at:

11. Governing Law

These Terms and any dispute related to our services are governed by the laws of the State of Kansas.

Any legal action must be brought in the state or federal courts having jurisdiction in Douglas County, Kansas.

12. General Terms

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.

We may update these Terms from time to time. The current version will be posted at:
